Council By-law Review

Council is undertaking a review of its existing by-laws as they are due to expire on the 1 January 2019 pursuant to section 251 of the Local Government Act 1999.

At the meeting of Council on Monday 19 March 2018 the proposed by-laws were adopted by Council for public consultation.  As part of the consultation process the proposed by-laws must be referred to any relevant Government body or agency for their comment prior to them being released to the community for comment.

The community were invited to comment on the proposed by-laws from Thursday 12 April 2018 to 9am on Monday 7 May 2018.

The proposed By-laws are based on Council's existing By-laws and have been amended to address any legislative changes that have occurred since the By-laws were last adopted in 2011.  No major changes have been made.  

A minor amendment has been made to By-law 2, 3 and 4 to include reference to existing Council policies that relate to their operation:

By-law 2 -  Community Advertising Policy 2.63.6

By-law 3 and 4 -  Fundraising Activity on Local Government Land and Roads Policy 9.63.23

The proposed Council By-laws are: 

  1. By-law No. 1 - Permits and Penalties By-law 2018
    A By-law to create a permit system for Council By-laws, to fix maximum and continuing penalties for offences, and to clarify the construction of Council By-laws.

  2. By-law No. 2 - Moveable Signs By-law 2018
    A By-law to set standards for moveable signs on roads and to provide conditions for the placement of such signs for the purpose of protecting visual amenity and public safety.

  3. By-law No. 3 - Roads By-law 2018
    A By-law to manage, control and regulate certain activities on roads in the Council's area.

  4. By-law No. 4 - Local Government Land By-law 2018
    A By-law to manage and regulate the access to and use of Local Government land (other than roads).

  5. By-law No. 5 - Dogs By-law 2018
    A By-law to limit the number of dogs kept on premises and for the management and control of dogs in the Council's area.

The public were invited to make a written submission to Council via letter or email or by submitting a Community Feedback Form that was available on Council's website or in hardcopy form from the Council Administration Office and Port Lincoln Library.   

Next Steps

All feedback received during the public consultation process will be taken into consideration and any identified amendments will be made to the relevant By-law before being presented to a meeting of Council for adoption.  If however, after community feedback there is significant changes made Council will again seek community feedback (and any relevant referrals) on the by-laws.
