Council Development Assessment Panel

This guide provides information about the role of the Council Development Assessment Panel (CDAP) in the assessment of development applications.

The role of CDAP

The CDAP operates under the Development Act 1993 and its role is to act as a planning authority to assess applications for development. Council has no input into the decisions made by CDAP.

Whilst most development applications are determined by council staff under delegation, the CDAP considers certain types of applications. For example, it determines those that have been subject to the statutory notification process (where representations have been made); development considered to be of significant social, economic or environmental interest; applications lodged by the Council itself where the development costs exceed a particular amount; and applications involving the removal of a significant tree that has substantial amenity value.

When and where does the panel meet?

The CDAP meetings are held every month, unless otherwise advised and are public, so anyone may attend. They start at 5.30pm and are held at the City of Port Lincoln Council Chambers Level One, Civic Centre, 60Tasman Terrace, Port Lincoln (unless otherwise notified).

Viewing CDAP agendas and minutes

The meeting agenda is placed on display at the City of Port Lincoln, Level One, Civic Centre, 60 Tasman Terrace Port Lincoln, on the Friday morning before the meeting, and is also available on Council’s website. Reports can be viewed on Council’s website on the Friday before the CDAP meeting. Alternatively, reports and attachments may be viewed at the Civic Centre. It is important to note that for copyright reasons, Council does not provide copies of attachments. Also, for security reasons, copies of floor plans are not made available to the public.

Copies of meeting minutes are available on Council’s website or at the Civic Centre within five business days after the date of the meeting.

Composition of the CDAP

The CDAP consists of seven members, with a minimum of four being independent of Council.

All members have voting rights and decisions are made on a majority basis. Independent members of the panel usually have professional expertise relevant to the planning profession

Can I address the CDAP when they consider my application?

Only representors who have made a submission as a result of the formal public notification process (see Information guide—Public notification), are entitled to speak before the CDAP.

Applicants can only speak to support their application in situations where a representor has been heard at the meeting. CDAP meetings are conducted in a less formal environment than traditional Council meetings.

Tips for making good representations are:

  • Remain as relaxed as possible
  • Write down the points you wish to make so that you don’t forget to cover any issues you wish to raise
  • Make your points in a simple, clear and concise manner (representations should be limited in  duration)
  • Base your argument on the issues included in the City of Port Lincoln Development Plan as the CDAP is required by law to base its decisions on the policies contained in this document.
  • The CDAP members have copies of all representations, so it is unnecessary to spend a large amount of time on arguments which have already been submitted in writing.
  • CDAP allows 5mins per speaker making a representation
