Mobile Food Vendor Location Rules Policy

New Local Government Mobile Food Vendors legislation was passed in State Parliament late 2017 and is expected to come into effect from 1 March 2018.  Council is required to prepare a list of areas where mobile food vendors can be permitted to operate from within the Council area.    

Council cannot restrict the type of food sold by the mobile food vendors but is required to prepare 'location rules' that includes sites from which the mobile food vendors may operate, the number of spaces available and hours of operation.  In identifying these sites the Council has taken into account legislated requirements including location, number and operating hours of nearby bricks and mortar businesses.  Council is also required to be mindful that the operation of the mobile food vendors does not impact on pedestrians, traffic movement and quiet enjoyment of nearby residents. 

A draft Mobile Food Vendor Location Rules Policy has been developed and includes eighteen sites selected where mobile food vendors can operate from, once a permit has been obtained by Council.   

Council invites the community to provide feedback on the proposed sites outlined in the Draft Policy.

The proposed sites are:

  2. Billy Light's Point
  3. Bridge Crescent
  4. Eyre Park
  5. Flinders Park
  6. Nelson Square Reserve
  7. O'Connor Reserve
  8. Pioneer Park
  9. Rustlers Gully Playground
  10. Shelley Beach
  11. Snapper Rock
  12. South Point Reserve
  13. Tasman Terrace - Jetty Car Park
  14. Tasman Terrace - Eyre Street junction Car Park
  15. Train Playground
  16. Visitor Information Bay
  17. Wellington Square
  18. Whait Reserve
