Dispute an Expiation

A person who has received an expiation for an alleged offence may apply to Council for a review of the decision before the due date on the original expiation.  Council will assess the request in accordance with Council's Withdrawal of Expiation Notice Policy 20.63.2 [PDF].

To request Council to review the decision the person must complete the Review of Decision Application Form 20-71-T67 [PDF] and provide evidence to substantiate the information provided in the Statement of Appeal section of the form before the due date on the original expiation.

You will be advised by Council of the outcome once a decision has been made.

If you are not satisfied with the outcome of the appeal, you are entitled to lodge a second appeal which will be assessed by another party.  Once a decision has been made you will be notified in writing of the outcome.

Verbal requests to waive an expiation will not be considered.

If you have received an Expiation Notice for an alleged offence you are required to make payment within 28 days from (and including) the date of the notice unless an arrangement has been entered into under section 20 of the Fines Enforcement and Debt Recovery Act 2017.
