Council Registers and Codes

Pursuant to Section 125 of the Local Government Act 1999 Councils are required to have appropriate policies, practices and procedures of internal control in order to ensure that they carry out their activities in an efficient and orderly manner, ensure adherence to management policies, safeguard community assets, and secure (as far as possible) the accuracy and reliability of Council records.

Council's policies and codes can be accessed from our Council Policies page or can be inspected (without charge) at the Council Administration Office, Level One, Civic Centre, 60 Tasman Terrace, Port Lincoln during normal business hours, 9.00am to 4.30pm, Monday to Friday or can be obtained on payment of a fixed fee by Council as per the Fees and Charges Schedule.

Council retains the following registers pursuant to the Local Government Act 1999 and Local Government (Elections) Act 1999;

Councils have certain functions and duties which they must perform, and certain powers which they may exercise, pursuant to the Local Government Act 1999 as well as a range of other Acts. In most cases the relevant Acts place these obligations and powers directly with Council. As it is not practical nor efficient for the Council as a body of Council Members to perform the many operational activities that are required in the day-to-day administration of the Council's roles and functions, Section 44 of the Local Government Act 1999 allows a Council to formally delegate many of its powers and functions (within certain stated conditions and exemptions) to the Chief Executive Officer, who may then sub-delegate these powers and functions to other responsible staff.  Council may also delegate its powers and functions to a Committee of Council.

All delegations made by the Council can be revoked at any time and do not, except in limited circumstances, prevent Council from acting in a matter itself.  In addition, an officer to whom a delegation has been made may choose not to exercise that delegation and bring a matter direct to Council or another Officer with delegations, for determination.

The City of Port Lincoln Delegations Register (‘the Register’) has been established to meet Council’s operational requirements and is a record of the powers and functions that have been delegated from Council to the Chief Executive Officer (or a person acting in that capacity).

As set out in Section 44 (6)(a)  the Delegations Register is reviewed by council within 12 months after the conclusion of each periodic election.

The Delegations Register is available for inspection (without charge) at the Council Office and an extract can be obtained on payment of a fee fixed by Council, or refer below.

Listed below are the documents that together comprise Council’s Delegations Register under which council administers, on a day-to-day basis, the relevant delegated powers identified under each Act.

Pursuant to Section 68 of the Local Government Act 1999, the Chief Executive Officer is required to maintain and publish a Register of Interest for all Council Members on Council's website, ensuring that a person's residential address, or any other address suppressed under section 68(4) of the Act, is not published.

Pursuant to Section 72A of the Local Government Act 1999, a member of a council who receives a gift or benefit of an amount greater than the amount determined by the Minister (by notice in the gazette)*, must provide details of the gift or benefit to the chief executive officer of the council.

A Council Member Gifts & Benefits Register is maintained in accordance with Section 72A(4) of the Act, and the declared gifts and benefits are included in the Register.

*For the purposes of Section 72A(2) of the Act, the value of $50 has been gazetted by the Minister on 17 November 2022.

Pursuant to Section 73, 74, 75 and 75A of the Local Government Act, 1999 the Council must publish on its website details regarding disclosures of general or material conflicts of interests by Council Members.

Pursuant to Section 79 of the Local Government Act 1999, the Council must keep a Register of Allowances and Benefits, in accordance with principles (if any) prescribed by the regulations, in respect of each member of the council:.

Pursuant to Section 80A (2h) of the Local Government Act 1999, the Chief Executive Officer is required to maintain a register relating to training and development of Council Members.

Pursuant to Section 105 of the Local Government Act 1999, the Chief Executive Officer of the Council must keep a Register of Remuneration, Salaries & Benefits , in accordance with principles (if any) prescribed by the regulations:

(a)   the title of each position held by an employee of the council; and
(b)   in relation to those positions held by employees who are paid according to salary scales set out in an award or industrial agreement;

(i)   the classifications of the employees who hold those positions; and
(ii)   the salary scales applicable to each classification (indicating in relation to each scale the number of employees who are paid according to that scale); and
(iii)   details of other allowances or benefits paid or payable to, or provided for the benefit of, any of those employees as part of a salary package; and

(c)   in relation to each position held by an employee who is not paid according to a salary scale set out in an award or industrial agreement referred to above:

(i)   the salary payable to the employee who holds that position; and
(ii)   details of other allowances and benefits paid or payable to, or provided for the benefit of, the employee as part of a remuneration package.

Pursuant to Section 116 of the Local Government Act 1999, Council must maintain a Register of Interests for use by the Chief Executive Officer and is not available for public inspection under this Act.

Pursuant to Section 119A of the Local Government Act 1999, an employee of council who receives a gift or benefit of an amount greater than the amount determined by the Minister (by notice in the gazette)*, must provide details of the gift or benefit to the chief executive officer of the council.

An Employee Gifts & Benefits Register is maintained in accordance with Section 119A(4) of the Act, and the declared gifts and benefits are included in the Register.

Pursuant to Section 188 of the Local Government Act 1999, Council must keep a list of fees and charges imposed under this section on public display at the Council Office.

Pursuant to Section 196 of the Local Government Act 1999, Council must prepare and adopt a management plan or management plans for its community land if:

(a)   the land falls within the ambit of section 194(1)(b) or (c); or
(b)   the land is, or is to be, occupied under a lease or licence; or 
(c)   the land has been, or is to be, specifically modified or adapted for the benefit or enjoyment of the community.

The City of Port Lincoln has two community land management plans:

Community Land Management Plan 2 - Parks, Gardens and Reserves [PDF]

Pursuant to Section 207 of the Local Government Act 1999, Council must keep a register of all community land in its area.  The Community Land register is available for inspection (without charge) at the Council Office and an extract can be obtained on payment of a fee fixed by Council.

Pursuant to Section 231 of the Local Government Act 1999, Council must keep a register of public roads in its area.

Pursuant to Section 252 of the Local Government Act 1999, Council must keep a register of all By-laws made or adopted by Council.

The City of Port Lincoln has five By-Laws and copies are available for inspection (without charge) at the Council Office and an extract can be obtained on payment of a fee fixed by Council.
